TAXPAYER GROUPS AGAIN CHALLENGE STATE FUNDING FOR CONTROVERSIAL STEM CELL RESEARCH

ALAMEDA COUNTY, CA -People's Advocate and the National Tax Limitation Foundation, two taxpayer groups based in the Sacramento area, filed a legal action for declaratory and injunctive relief today in the California Superior Court in Alameda County. The action asks the court to halt taxpayer funding of the Independent Citizens' Oversight Committee (ICOC). The ICOC is the entity established by the California Stem Cell Research and Cures/Bond Act after the passage of Proposition 71 in the November 2004 election. The action was filed in Alameda County because it is the county in which the ICOC office is located.

The complaint raises legal issues similar to those raised in the original petition filed with the California Supreme Court in February 2005. The Supreme Court declined jurisdiction to consider the petition in March, indicating by their order that Petitioners should seek another venue.

This legal action is essentially seeking the same remedy as the petition, asking that various state agencies authorized under the Act to disburse funds from the State Treasury to the California Stem Cell Research and Cures Fund be prohibited from doing so since the entity is not under the exclusive management and control of the state, as required by Article XVI, section 3 of the California Constitution.
